Court throws out suit against ADC leaders David Mark, Aregbesola


Justice Joyce Abdulmalik of the Federal High Court in Abuja has dismissed a suit that sought to remove Senator David Mark and former Governor Rauf Aregbesola as National Chairman and National Secretary of the African Democratic Congress (ADC).

The judge ruled on Friday that the case involved the internal affairs of a political party, an area over which courts have no authority.

In her judgment, Justice Abdulmalik noted that membership and leadership of a political party are voluntary, explaining that political parties are voluntary associations without any form of compulsion.

The Judge held that members aggrieved over matters of their parties should always employ internal mechanism to resolve such grievances or at best, opt out and join other parties.

She maintained that cases bordering on party membership and leadership are not justiceable and as such, courts cannot exercise jurisdiction.
